The United States Supreme Court today ruled that warrantless use of GPS tracking devices is a violation of the US Constitution. The ruling was handed down by an unanimous Court, which invalidated the conviction of an alleged drug dealer whose movements were tracked through the use of a GPS device planted on his car.
The reversal of the conviction was unanimous, but the reasoning behind the reversal was not. The majority of the Court declared in an opinion authored by Justice Scalia that placing the tracking device was a physical intrusion upon a private area, and therefore constituted a “search”. The opinion of the Court was joined by Thomas, Sotomayor, Kennedy and Roberts.
